Workers Compensation Information

Workers compensation laws were established to ensure that employees injured on the job receive fixed financial benefits, reducing the need for lawsuits and providing an easier process for employees. These laws also help employers manage the financial risks associated with workplace injuries, as many states limit the amount an injured worker can recover from an employer.

Workers Compensation Insurance helps businesses cover these benefits. To protect employees, most states mandate that employers carry some form of Workers Compensation Insurance. It’s important to note that Workers Compensation is not health insurance; it specifically covers injuries sustained while on the job.

In most states, employers are legally required to carry Workers Compensation coverage if they have employees. Even in states where it’s not mandatory, it’s highly recommended, especially if you have a large number of employees or if they are involved in risky activities.

Do I need Workers Compensation Insurance?

Employers are legally obligated to provide a safe work environment. However, accidents can still occur despite all reasonable safety precautions.

To shield employers from lawsuits related to workplace accidents and to offer medical care and compensation for lost wages to injured employees, almost all states require businesses to have Workers Compensation insurance. This insurance covers injuries that happen at work, whether on-site or while traveling for business, as well as work-related illnesses.

Workers Compensation provides compensation to injured employees, regardless of fault, covering lost wages, medical expenses, and rehabilitation. It also includes death benefits for surviving spouses and dependents.

Each state has unique laws about the amount and duration of benefits, how medical care is provided, and how disputes are resolved. For example, some states regulate whether the worker or employer can select the treating doctor and how disagreements about benefits are handled.

Workers Compensation insurance must be purchased as a separate policy. While business owners policies (BOPs) and in-home business insurance packages may cover other aspects, they do not include coverage for employee injuries.
